Filing a DMCA notice
To be effective under 17 U.S.C. § 512(c)(3), your written notice must include:
- A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
- Identification of the copyrighted work claimed to have been infringed (or, for multiple works, a representative list).
- Identification of the material claimed to be infringing, with information reasonably sufficient to locate it on the Site (the URL of the page is best).
- Your contact information: name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
Upon receiving a valid notice, we will remove or disable access to the identified material and take reasonable steps to notify the person who posted it.
Counter-notification
If your material was removed and you believe the removal was a mistake or a misidentification, you may send a counter-notification containing:
- Your physical or electronic signature.
- Identification of the removed material and the location where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your district (or, if outside the United States, for any judicial district in which we may be found), and that you will accept service of process from the person who filed the original notice or that person’s agent.
If we receive a valid counter-notification, we may restore the material in 10 to 14 business days unless the original complainant informs us that it has filed a court action seeking to restrain the alleged infringement.
A word of caution
Under 17 U.S.C. § 512(f), a person who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys’ fees.
Repeat infringers
We terminate access privileges of repeat infringers in appropriate circumstances.
Non-copyright complaints
For matters other than copyright, such as trademark or privacy concerns, email legal@countrybucket.com with a description of the issue and the URL involved.
